Alternative Dispute Resolution (ADR) is an alternative method of resolving disputes to that of Litigation. In the Construction Industry in both Ireland & the United Kingdom, all Standard Forms of Main Contract and Sub-Contract utilise ADR and the vast majority if not all bespoke Forms of Contract employ ADR by utilising one or more of the methods indicated on the adjoining pages. All of the processes have distinct advantages and disadvantages over others and thus, it is important to obtain specialist advice when considering one’s options.

The Irish & UK Justice Systems advocate the use of ADR for the resolution of Civil Disputes noting that ADR is particularly useful in the settlement of Commercial Disputes.  See: Law Reform Commission Report - Alternative Dispute Resolution: Mediation and Conciliation published November, 2010.
